Report it to their web host. It is illegal, and they could go to jail for that. You could also report it to the FBI's computer crimes division.

You should note that many hackers will use systems they have previously taken over to launch further attacks. It is very likely that the owner of the site may have had nothing to do with the attacks. Just something to keep in mind. Report it to the abuse division of their hosting asap, hopefully they haven't cleaned any logs :)

Also report it to the web hosting company where the site is hosted, and not just the web hosting company, even contact their uplinks.

If you problem with it, give me the domain, i will try to get you all the contact emails for that ip/domain

If its important that the users are not logging in to a fake site I would have emailed the members warning them.

It breaks a number of laws, including copyright if your website is copyrighted.

Take it up with what the first person said. I would email him first and ask him to stop before you do, if you want to be nice. That is if you know his email.

after having been exposed to various hacker attempts earlier, I posted once an article on security aspects in my blog including a list of official FBI/CIA/IC3 links for official reporting and help on cyber crimes

may be this info may help you to report and solve your issue
