    Interesting, they knew that the case could not be won by claims of libel, so they went after Trademark infringement.

    Shawn has commented that as long as you are telling facts from an actual event that you can publish and not be considered libelous for those comments as he did in the Winn & Simms case with his Blog.

    Not only that but they seemed to have ruled you can own their name in the form of the domain and not be breaking any laws.

    If memory serves, Shawn had to give up the domain although I thought that was agreed on outside of court.

    It is interesting nonetheless

    You can in some cases, but they could get the domain in some cases if they took it to ICCAN and made a case of Trademark infringement.

    The court is not the final authority on domains.

    It has always been my understanding that if the domain name contains a trademarked name in some way, as long as it is not being used commercially, to benefit in some way from the use of the trademark, you are fine.
