Flash Game license liability?

    Hi all,

    I am thinking about purchasing a flash game for my website. It's a customized single flash game (not an arcade package) and the creator is selling the license for it.

    My question is, am I liable if the game is not really the seller's IP, even though the creator claims it is in an email?

    What's the worse that would happen if the creator sold me a game that really wasn't his? I get an email asking for the game to be removed by the original owner, or will I get sued?
