How should I have people sign my contract? Can they just type their name?

I'm wondering how to have my customers to my web design business sign my contract. Do we really have to mail it back and forth, or can he just type his name on the line?

    thanks

Depends how solid you want it to be. If it is a serious thing, I would suggest you have them sign it at a notory and get it notorized. This is good since you are not necessarily doing face to face business.

If the government allows people into pornographic sites with the clicking of an agree button, isn't that good enough for me too?

I'd like to hear how others have their contracts signed.

It all depends (of course ;) ). If you are selling $30 designs, click of a button will be enough. If you are selling $3.000 designs, send them a contract that they have to sign and send back to you.

It's about what you are comfortable with. Some customer might be annoyed by something and then challenge you to prove that they really clicked on that button. E-Mail communication and things like that are not sufficient evidence in a court.

    I don't know about that....
A simple verbal agreement is binding in court, so I don't see why something in writing wouldn't be.

By itself it's not sufficient because you'll have problems proving it. The other party just has to say "no, I never said that" or "I never sent that mail" and you'll have to prove that they actually did it.

of course a verbal agreement is binding.. If both parties agree on what was said. Now.. Why would they go and agree on something like that? They are in court because they disagree... Hence the problem with verbal contracts. If you just have a button..

Don't take my word for it, see a lawyer...

Proving beyond doubt that it was me who clicked on that button? Good luck with that. I wonder why companies use these outdated things called contracts when they can just sign an INTERNET FORM.
