    Well in my opinion a Google representative would say it was as it may MISLEAD users into clicking the ads.

    what you mean by "labeling"?

    And if I let the ad unit inside the box, but with the gray strip, now above the ad unit, under the ad unit?

    there is label over the google ads . i think it is against the tos. you can not use it
