Serious problem, hopefully someone can help

    Hey Guys,

    I had a domain registered with dotster that I've had for several years. I used the e-mail address associated with this domain as my primary contact address and got about 30 e-mails from clients or past customers or other business contacts each day. For some reason Dotster didn't auto-renew the domain for me, and someone else grabbed it.

    The domain is the name of a business I have registered legally, etc. It is seriously killing me not being able to contact these people. The worst part is that some of my customers/clients probably need help with services and don't know how else to reach me. Due to the nature of the business, I don't have all of their info readily available (it's sort of an affiliate-type thing).

    What can I do to get this back? I ran a WhoIS and the guy has registered it through PrivacyPost.com. I tried all of their phone numbers and e-mails and just had automated voicemail responses, and the e-mails bounced.

    As of now my next move is to contact dotster tomorrow to see what they can do.

    Does the domain contain your business name or a trademark?
    That would be about the only way you'd have a chance to get it back, but you'd have a legal fight.

    If there's no trademark, you've got buckleys really, its your responsibility to ensure the domain was renewed.

    There's no trademark, but the domain is the business name.

    It sounds like it already went through the redemption period, so I'm afraid there is nothing you can do to recover the name. Is it a very unique name, i.e. has anyone used the name (not just the domain, but anywhere) before? If so, you might be able to prevent the new owner from using the name in the same type of use, but not to recover the domain. Perhaps you could make an offer to buy it - but I would suggest NOT telling him you used to own the domain as they will then likely try to get more money for it.

    It's up to you to make sure the domain is renewed. If you could prove gross negligence, you might be able to sue for damages (highly unlikely) but that wouldn't get the domain back.
