Mobile Phone Journalist Awarded £1m

A Slovakian journalist, left severely injured following a road traffic accident, has won his personal injury compensation claim and been awarded in excess of £1m. Milan Rybansky, then 34, was knocked down by a car in Newtownabbey, near Belfast, nearly six years ago. However the £1.125m award was less than it may have been as Mr Rybansky was using his mobile phone to send texts when he was hit.

According to the BBC News website Mr Rybansky, from Bratislava, had only moved to Belfast six weeks before the accident took place in December 2004. The accident caused severe trauma to the brain which has left the journalist, previously fluent in 3 languages, unable to talk. He is also confined to a wheelchair and has only limited use of his hands.

Following the accident Mr Rybansky returned to his home country where he now requires 24 hour care. In order to provide the level of care required his parents have been forced to sell their home and give up work.

The case against the driver, who has not been named, and his insurance company was originally disputed as it was argued that Mr Rybansky was in fact at fault for the accident because he was using his phone. However, agreement was eventually reached that the driver shared liability as he should have seen Mr Rybansky.

The award, the level of which reflects the seriousness of Mr Rabinksy’s injuries, has now been fully approved by the High Court, and has been described as ‘life-changing’ by Mr Rybansky’s legal team, adding that it allowed for some quality of life for their client and his parents.
