    Since they are modifying the code, I would say that this is a TOS violation.

    I wouldn't use that, either. Not just for the TOS issues, but have you ever encountered one of these ads while doing some random surfing? They are ANNOYING! You'll piss off a lot of your users with crap like that!

    Agreed. It may increase your CTR for about a day and then it'll drop dead because users will stop going to your site due to the annoying ads.
